House Bill 4139 is Political Overreach (Candidate Opinion)

For the record, I do not support the current version of House Bill 4139 – which is being billed as “An Act Modernizing Firearm Laws”. H. 4139 is purely a knee jerk reaction and a political stunt by the Healy administration in protest to a 2022 supreme court decision.

H. 4139 is also a perfect example of why we as a country cannot find common ground on sensible firearm reforms…Instead of just addressing the issue at hand, that stemmed from the supreme court decision, and working with opponents on a compromise bill…Healy and her team used this opportunity to go for the jugular on any and all 2nd amendment rights we had as residents of the commonwealth by expanding the scope and reach of the bill.

There are many components of the bill that both sides could have agreed upon;

– Banning individuals from carrying firearms in government buildings/polling locations.

– Strengthen “Red Flag” laws.

– Additional laws on “Ghost Guns”.

– Increased training of firearm owners.

These are all things reasonable people can support…myself included…However, Healy and the legislature knowing they have a super majority…just could not. You give them an inch…they take a mile.

Hidden in the bill are significant new restrictions on cosmetic additions/alterations that are present on the majority of current firearms. Additions/alterations that have NO effect on the firing rate or lethality of that firearm. So why would they do this? Because they know that if they come out and just ban ownership of these firearms…they will most likely lose in court.

So instead, if you ban very specific components of what are included on all modern firearms…you by default…ban the ownership of those firearms in a backdoor way.

Massachusetts is in the top three lowest gun violence states in the country…and that is something we should be very proud of…but H. 4139 in its current form will not improve that number. The types of firearms being targeted by the cosmetic bans in this bill are NOT the types being used in the already low volume of crime we have in the state…it is actually the alternative. The ban specifically targets the majority of the half a million responsible and licensed gun owners in the Commonwealth.

I understand that some individuals will never understand why someone would want to own a firearm, I get that. However, understanding the passion and responsibility of firearm enthusiasts is crucial in a nuanced discussion about gun ownership. Many individuals who own firearms do so with a deep sense of responsibility and respect for the laws governing their use. Banning firearms outright would unfairly penalize these responsible gun owners and enthusiasts, stripping them of a legitimate interest and, in many cases, a constitutionally protected right.

Firearms serve various purposes: self-defense, hunting, sport shooting, and historical collection. For many, these activities are deeply embedded in their culture and way of life. Sweeping bans fail to recognize the commitment of responsible gun owners to safety, training, and lawful use.

It’s important to consider that any call to ban a particular right or item can set a precedent. Imagine a scenario where something you value and enjoy—whether it’s a hobby, a form of expression, or a right you hold dear—comes under similar scrutiny. Just as with firearm ownership, broad bans on these interests could be seen as an infringement on personal freedoms and rights.

The key lies in finding a balance that respects individual rights while addressing legitimate concerns about safety and misuse. Solutions like improved background checks, mandatory training, and responsible storage laws can help ensure that firearms are used safely and responsibly without penalizing law-abiding enthusiasts.

By fostering mutual understanding and focusing on practical, balanced approaches, we can address safety concerns without compromising the freedoms of responsible individuals.

H. 4139 does none of this….
